Let’s play court (and watch the big kids duke it out).
Attorneys, what advice would you give to someone who can’t afford a lawyer and is representing themselves in court?
Take a few days and go to the courthouse and attend trial call and then watch trials. Watch them from start to finish. Try to get into every judge’s courtroom so that if you get assigned to a specific judge you know a little bit about how they run their courtroom. If you are going to do a jury trial, learn how all the judges do their jury trials, how they select jurors and what questions they allow and by whom. Watch how the lawyers introduce exhibits and learn the specific language, but don’t assume they are doing it right. Read books about trial practice. There is magic language that even lawyers screw up, and while they may get through the trial they make appellate lawyers tear out their hair. If you are lucky enough to watch someone else try their own case without a lawyer, pay close attention. Try to learn from their mistakes.

Dog toy poking fun at Jack Daniel’s leads to dispute over parody exception to trademark protections
The Jack Daniel’s bottle next to the VIP Products “Bad Spaniels” dog toy.
It is fair to expect Wednesday’s arguments in Jack Daniel’s Properties v. VIP Products to be heated, as the justices consider the possibility that protection for parodies requires an exception to traditional trademark protections.
