Covid Amnesty? I think not. Let me explain.
While there has been great and deserved vehemence directed toward those who now seek absolution for their sins, there’s better reasons to refuse to allow them the quick and easy self-exoneration they offer in their snide little article. They put forward this olive branch as if the other side, the right side, the thoughtful and contemplative side, might bear some of the blame for their behavior. Amnesty suggests that theirs was a sort of societal error, not exactly the mea culpa one might expect and deserve, but rather a shrug of the shoulders, a “well, I didn’t see that coming,” sort of error. They see this as a war and they just lost a battle, so they wave the white flag and ask for a truce after killing half our battalion with poison gas.

Let’s review some recent caselaw.
Plaintiff who self-identifies as “an openly transgender female,” sued the Miss United States of America pageant . . .
. . . alleging that the Pageant’s “natural born female” eligibility requirement violates the Oregon Public Accommodations Act (“OPAA”). The district court granted the Pageant’s motion for summary judgment, holding that the First Amendment protects the Pageant’s expressive association rights to exclude a person who would impact the group’s ability to express its views.

Saudi Arabia Reiterates Commitment To China, Regardless Of U.S. Concerns
That MbS seemingly now sees the U.S. as a partner just for its security considerations, with no meaningful quid pro quo on Saudi Arabia’s part, whilst regarding China as its key partner economically and Russia as its key partner in energy matters, should not surprise the U.S. Back in March last year it was made clear . . . when Aramco chief executive officer, Amin Nasser said: “Ensuring the continuing security of China’s energy needs remains our highest priority – not just for the next five years but for the next 50 and beyond.” And yet, the U.S. is surprised by the apparent finalization of the transition of Saudi Arabia away from Washington and towards China, which effectively marks the end of the 1945 core agreement between the U.S. and Saudi Arabia that defined their relationship up until extremely recently.

Affirming in part, the panel held that the compensatory damages were not precluded by the First Amendment. The panel held that under Cohen . . ., and Animal Legal . . ., facially constitutional statutes apply to everyone, including journalists. The panel reversed the jury’s verdict on the claim under the Federal Wiretap Act, 18 U.S.C. Section 2511(2)(d), and vacated the related statutory damages for violating this statute.

Technology has made it easier than ever to record someone, but although it may be simple…it’s not always legal. In the United States there are 13 states that have some form of All Party Consent laws codified, however, 3 of these states also have some instances where one party consent is applicable.
