If there were a fail-proof system that would guarantee freedom and diverse conscience, it probably came closest with the American system of the founding, but as we have seen, given enough time, all things can be corrupted, so we either shorten the time of the validity of the system, or increase the severity and frequency of punishing the violation of that system’s rules, focusing more on those in government than those in the public. If we had a separate judicial branch that focused solely on government employees and officers, that prosecuted lapses and violations of oath we might get closer to truly representative government.
In this sense, every act of usurping authority for one’s personal gain is treason. Should it be punished as treason? Who would carry the burden of authority if any personal benefit accused them of treason?

The demanding standards for bringing constitutional claims against a city often support the old adage that you can’t fight city hall. But sometimes you can. Greetings all:I have already provided most of you with links to the opening brief, the government’s answering brief, and the reply brief, in an appeal of the revocation of my supervised release. Thus this appeal is fully briefed.
Herewith please find a link to a motion for release pending appeal. For most of you, this is the only new pleading.
The first point on appeal is a challenge to the sufficiency of the evidence. As you can see, the government made no attempt to rebut that claim, or to show that the evidence was sufficient to convict. It wasn’t, and they know it. They just couldn’t bring themselves to forthrightly admit the undeniable.
My main point on the motion for release pending appeal is that the government, faced with a challenge to the sufficiency of the evidence, refused to make the slightest attempt to prove that I am wrong, and that the evidence is sufficient.
They claimed I couldn’t challenge the sufficiency of the evidence, on technical grounds. However, my 4th point on appeal, “fraud upon the court” defeats the government’s technical defense.
The government didn’t challenge the law or the facts, on my claim of “fraud upon the court.” Therefore, their defense is undeniably invalid. Therefore, I should be released from supervised release, until the appellate proceedings are concluded.
