Clearing up Common Misconceptions About the Charges Against Trump

Nothing in the charges filed Wednesday (https://www.politico.com/f/?id=00000189-b2ee-dee7-a7ab-faffe6790000) seeks to punish the former president for speech or advocacy as such. While the indictment does recite many things Trump said and calls them false, it identifies each such statement as being part of an overall course of conduct satisfying the elements of a crime under one of four federal statutes: conspiracy to defraud the United States, 18 U.S.C. section 371 (https://www.law.cornell.edu/uscode/text/18/371); conspiracy to obstruct an official proceeding, 18 U.S.C. section 1512(k) (https://www.law.cornell.edu/uscode/text/18/1512); obstruction of and attempt to obstruct an official proceeding, 18 U.S.C. section 1512(c) (https://www.law.cornell.edu/uscode/text/18/1512); and conspiracy to deprive persons of protected rights, 18 U.S.C. section 241 (https://www.law.cornell.edu/uscode/text/18/241).

The latest bribery case out of New Jersey

The State charged defendant under the bribery statute. Defendant did not win the election. He contended the applicable statute did not apply to him because it did not cover candidates who accepted improper payments but were not elected. The trial court dismissed the indictment, finding that N.J.S.A. 2C:27-2(d) did not apply to defendant.

So sad, too bad—the appellate court fixed this one.

The little sick doggy

Plaintiff’s dog, Clinton, suffered from health problems. The solution, at least according to a veterinarian, was to feed him specialized dog food available only by prescription. It has different ingredients than regular dog food but includes no special medication. Prescription dog food is expensive. The crux of Plaintiff’s complaint is that the “prescription” requirement is misleading because the Food and Drug Administration never actually evaluates the product. And the damages came from its higher sales price. The original complaint, which included only state-law claims, reflected these theories.

Class actions and filthy lucre for attorneys

Plaintiffs’ lawyers filed a class action lawsuit on behalf of copyright holders of musical compositions and ended up recovering a little over $50,000 for the class members.

The lawyers then asked the court to award them $6 million in legal fees.
